TERMS OF
USE AGREEMENT
By clicking “I Accept” below or accessing, using, or
downloading any part of the modules, you expressly agree to
and consent to be bound by the terms of this agreement. If
you do not agree to the terms of this agreement, click “I Do
Not Accept,” and do not access, use, or download any part of
the modules.
1.
License Grant and
Limitations.
“Modules” means those Georgia’s Leadership Institute for
School Improvement Performance-based Modules designed for
use for professional development purposes for school leaders
and teachers, which are accessible through the following Web
site link: www.galeaders.org.
The
Modules are owned by the Board of Regents of the University
System of Georgia (BOR) and are protected by U.S. and
international copyright laws. BOR hereby grants to you a no
cost, non-exclusive, non-transferable license to use the
Modules as follows:
a.
You may only use the
Modules in the state of Georgia;
b.
You will only allow the
Modules to be used by performers in an actual school
environment where assistance and feedback against the
specified criteria included in the Modules are available.
You may make and distribute copies of the Modules to such
performers for use under this provision, provided that you
do not charge the performers a fee for such Modules, other
than a fee for actual expenses of copying if the Modules are
provided in print;
c.
You may not make
derivative works of the Modules; and
d.
You must reproduce and
include any copyright and trademark notices and logos on
each copy of the Modules made by you.
Use of
the Modules is restricted to Georgia schools and school
districts, RESAs, Georgia
Department of Education leadership facilitators, Leadership
Performance Coaches who have completed training provided by
Georgia’s Leadership Institute for School Improvement, and
Georgia colleges and
universities with educational leadership and/or teacher
preparation programs.
2.
Termination.
This Agreement is effective upon your acceptance as set
forth above and shall continue in full force until
terminated. You may terminate this Agreement at any time and
for any reason. BOR reserves the right, at any time and for
any reason, to:
a.
Remove or disable access
to all or any portion of the Modules;
b.
Suspend your access to
or right to use of all or any portion of the Modules; and
c.
Terminate this
Agreement.
3.
Disclaimer of Warranties. The
Modules are provided on an “as is” basis without warranty of
any kind, express or implied. BOR does not make any warranty
as to any results that may be obtained by use of the
modules. BOR makes no other warranties, express or implied,
including, but not limited to, any implied warranties of
merchantability or fitness for a particular purpose, in
relation to the modules.
4.
Limitation of Liability.
Under
no circumstances shall BOR be liable to you or any other
person for any indirect, incidental, consequential, or
punitive damages arising out of or relating to this
agreement. Your sole and exclusive remedy hereunder shall be
for you to discontinue your use of the Modules and terminate
this agreement.
5.
Miscellaneous.
This Agreement shall be governed by the laws of the State
of Georgia. BOR shall have the right, at any time and
without notice, to add to or modify the terms of this
Agreement, simply by posting such amended terms herein. Your
access, link to or use of the Modules after the date such
amended terms are uploaded to the Web site through which the
Modules are available shall be deemed to constitute
acceptance of such amended terms.
This Agreement supersedes in full all prior discussions and
agreements between the parties relating to the Modules, and
constitutes the entire Agreement between the parties
relating to the Modules. |
